PERM (Labor Certification) Process For Employment Based Green Cards Applications PERM is the new procedure for Labor Certification, and stands for Program Electronic Review Management process. The PERM process requires the Applicant’s sponsoring employer to conduct a series of recruitment activities to determine if there is another applicant in the US for the same position. If there is not a qualified and willing applicant (US citizen or Permanent Resident) available for the position during the recruitment process, the employer is permitted to submit the PERM Labor Certification. The main requirement in PERM is that the petitioning employer is required to have all supporting documents ready prior to filing and should submit them to the Department of Labor within 30 days in the event the case is chosen for audit by the Department of Labor. PERM Labor Certifications are processed and adjudicated by the US Department of Labor within approximately 45 to 60 days.
