National Interest Waiver: EB2 Green Card Application

National Interest Waivers are filed for and reviewed in EB2 Visa
Applications.  EB2 Applications (Green card Applications For Applicants
of Exceptional ability in the arts, business, sciences advanced degree
professionals including physicians) require a
Labor Certification (PERM)
unless the Applicant can qualify for a National Interest Waiver.  National
Interest Waivers are granted to
EB2 Applicants that can benefit the
United States.  The advantage of a National Interest Waiver is
substantially reducing the wait time involved in Labor Certification
(PERM)
or to avoid having to work for the same employer as declared in the EB2
Application  Through a National Interest Waiver, the EB2 Applicant can
sponsor his or herself without requiring an employer’s sponsorship.    


Methods of Showing the Applicant benefits the United States to
Obtain a National Interest Waiver

An applicant can show that they benefit the United States by showing
that he/she will have a favorable impact on at least one of the following:

•        US Economy;
•        US Employment;
•        US Education;
•        US Housing;
•        US Environment;
•        US Culture; or
•        Some aspect of Life in the US.

In essence, the Applicant must show that they are seeking work in an
area of substantial intrinsic merit to the United States whereby they will
prospectively benefit the national interest to a substantially greater
degree than a similarly qualified available United States Worker would.  
The impact on the US cannot be merely local, but must benefit the US on
a national level.  In essence, the Applicant needs to prove that the
national interest would be adversely impacted if the process of Labor
Certification is required.
