601 Hardship Waiver
The 601 Hardship Waivers of Inadmissibility is a waiver for persons
deemed inadmissible under immigration law.  If successful in applying for
a
601 Hardship Waiver, the Applicant will be able to proceed with a Visa
or Green Card Application in which they are eligible for.

In establishing a
Hardship Waiver, it must be established that the
qualifying relative will suffer “extreme hardship” if the alien is not
admitted.  The grounds of inadmissibility can include prior unlawful
presence under (INA 212(a)(9)(B)(v)) or misrepresentation under (INA
212(i)).  

Who Qualifies for a 601 Hardship Waiver?
A qualifying relative is a Citizen or Lawful Permanent Resident (Green
Card Holder) Spouse or Parent of the Foreign National Applicant.  A US
citizen fiancé may also be a qualifying relative.    

What must be shown to be eligible for a 601 Hardship Waiver?
Waivers to these exclusions require it to be established that “the refusal
of admission to such immigrant alien would result in extreme hardship to
the citizen or lawfully resident spouse or parent of such alien”  Waiver for
past criminal history under (INA 212(h)) requires it be established “that
the alien's denial of admission would result in extreme hardship to the
United States citizen or lawfully resident spouse, parent, son, or
daughter of such alien.”
